Pikstree is a dynamic community of creators sharing freely accessible graphics content. These Terms of Service ("Terms") apply to the pikstree.com website, associated websites, software, mobile apps, plug-ins, and all other services provided by Pikstree (collectively, the "Service(s)").
 These Terms govern the relationship between Pikstree, and any user of the Services ("you", "your" or "User"). By utilizing the Services (including accessing and downloading Content from the Services, or contributing Content to the Services), you agree to the following:

Agreement to Terms:

By using the Services, you agree to be bound by these Terms, which constitute a legally binding agreement between you and Pikstree. You represent and warrant that you have the full legal capacity and authority to agree to these Terms and to fulfill all obligations listed herein. If you do not agree to these Terms, please refrain from using the Services.

Access for Minors:

Individuals under the age of 13 (or the minimum age required for consent to data processing in their respective country, with a minimum of 16 in Germany) may not access or use the Services unless explicitly authorized by a parent, guardian, or authorized adult who agrees to be bound by these Terms.

Pikstree reserves the right to modify or update these Terms at any time. Any changes will be posted on this page. We will make reasonable efforts to provide advance notice of any changes that materially affect your rights or use of the Services. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.

Content:

"Content" refers to all media available on the Services, excluding third-party paid advertising or sponsored content. Content includes, but is not limited to:

  • Videos: Moving images, animations, film footage, and audio-visual representations.

CC0 License:

Certain Content available for download on the Service is subject to the Creative Commons Zero (CC0) license ("CC0 Content"). CC0 Content can be used for personal and commercial purposes without attribution.

Content License:

Users may download, use, modify, or adapt Content (excluding CC0 Content) for commercial or non-commercial purposes, subject to certain prohibitions outlined below.

Prohibited Uses:

Prohibited uses include but are not limited to selling or distributing Content on a standalone basis, using Content in immoral or illegal ways, and using Content deceptively.

Attribution:

While attribution to Pikstree or the contributor of Content is not required, it is appreciated, especially for editorial uses.

Uploading Content:

Users who upload Content grant Pikstree a non-exclusive license to use and distribute the Content. Users are responsible for ensuring they have the necessary rights to upload Content.

Use of the Service:

Users must comply with all Terms and refrain from unauthorized data mining, copying, or reverse engineering of the Service.

Term and Termination:

These Terms remain in effect until your account is terminated. Pikstree may suspend or terminate accounts for violations of these Terms.

Dispute Resolution:

The Terms are governed by the laws of the Federal Republic of Germany, with Berlin as the place of jurisdiction.

Warranty and Liability:

Pikstree provides the Services and Content "as is" and does not guarantee uninterrupted or error-free use. Pikstree shall not be liable for any damages arising from the use of the Services or Content.

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect.

Prize Draws and Promotions:

From time to time, Pikstree may conduct promotions subject to additional terms and conditions.

EU Monthly Active Users:

Pikstree complies with EU Digital Services Act requirements regarding monthly active users.
